State witness challenges evidence in high-profile murder case

A State witness in the murder case of businessman Shailen Singh disputes evidence presented during the bail application of the accused brothers, Ferrel and Darren Govender.

In the Durban Magistrate’s Court this morning, advocate Paul Jorgensen made an application to have the affidavit of his client admitted into the court.

The State witness is believed to be the woman involved in an alleged love triangle that led to Singh’s killing.

Jorgensen told the court the dispute said this was in relation to audio and visual evidence that was presented to the court by the State.

He said his client had not provided that evidence to the State.

However, the senior State prosecutor, Nkululeko Msiya, argued that it was an attempt by the accused to reopen their cases and they were attempting to use a State witness in this bid. The magistrate refused the application.

Arguments in the bail application are ongoing.

Singh was killed while seated in his vehicle in a restaurant's parking lot in Meridian Drive, Umhlanga, on December 29.

The father of a two-month-old son, was shot multiple times shortly after leaving his home in Mount Edgecombe.

The 32-year-old owner of Shails Trans, a logistics company, was shot twice in the head, once in neck and abdomen. He died at the scene.

Days later, Ferrel, 40, the group chief executive officer of Pro Secure, a security company, and Darren, 35, the owner of a construction company, made their first appearance in the Durban Magistrate's Court.

They handed themselves over to police on January 1.

Last week, Singh’s father, Pradeep said they were calling for bail to be denied.

“My son was killed in a cowardly fashion and in broad daylight. Our family has been robbed, especially my two-month-old grandson who will never get to experience the love of his father because of this cowardly act.”
