The family of Phoenix grandmother, Kamatchee Naicker, who was allegedly stabbed to death by her grandson, were left “shaken” after the charges against him were provisionally withdrawn.

This followed the brief appearance of 26-year-old Lincoln Moodley in the Verulam Magistrate’s Court on Wednesday.

The charges were provisionally withdrawn pending finalisation of the investigation.

Moodley was arrested and charged with the alleged murder of 83-year-old Naicker, who was blind, in June 2025.

He is also accused of the attempted murder of his 64-year-old mother, Shirley Appalsamy. She was stabbed and her throat was slit.

Speaking to the POST after his court appearance, a relative, who declined to be named, said: “This development has shaken us to our core and has compounded the trauma we continue to endure. It is incomprehensible that an individual implicated in such a grave crime can be released while investigations are reportedly still in progress.

“This decision raises serious concerns about due process, accountability, and the justice system's commitment to upholding the rights and dignity of victims, particularly in cases involving gender-based violence and the abuse of vulnerable persons, including the elderly.”

She said the affected families deserved to understand the legal basis for this decision, and called for a review of how the matter had been handled.

“We will continue to pursue truth, accountability, and justice for our loved one. We refuse to allow this matter to be dismissed without answers, and we will not rest until the person responsible is held fully accountable under the law.”

At the time, the POST reported that both women were allegedly repeatedly stabbed with a butcher’s knife at their home in Westham, Phoenix, on June 9.

A small kitchen knife was also found at the scene.

Naicker, a grandmother of nine, sustained multiple stab wounds to her face and body. She was declared dead by Reaction Unit South Africa paramedics.

Appalsamy, a mother of two, sustained multiple stab wounds to both her cheeks, neck and hands, and her throat was slit. Resuscitation occurred before she was taken to a hospital.

Phoenix SAPS detectives arrested Moodley in Amaoti, north of Durban, on June 10.
